Learning licence

Who can apply

  • Any person after completion 18 years is eligible to apply for a Driving license (Learner/Permanent).
  • Any person after attaining the age of 16 yrs is eligible to apply for license for motorcycle without gear engine capacity not exceeding 50cc with written consent of parent/guardian.
  • The eligible age to apply for license to drive a transport vehicle in any public place is 20 yrs. No person shall be granted a learner’s license to drive a transport vehicle unless he has held a driving license to drive a light motor vehicle for at least one year.

Permanent licence

Who can Apply?

  • The learner license holder should appear for the test of competence for obtaining the permanent licence after 30 days and within 6 months from issue of Learner License. Learner's License is valid for 6 months and cannot be renewed.

Test Procedure / Points

  • Adjust rear view mirror.
  • Take suitable precautions like fastening of seat belts etc before starting engine.
  • Move away safely and smoothly straight ahead at an angle while at the same time use of all gears.
  • Change quickly to lower gear when the traffic conditions warrant such change.
  • Change quickly to lower gears while driving down hill.
  • Stop and restart on steep upward incline make proper use of hand brakes and of the foot brakes without rolling back, turn right and left corners correctly using rear view mirror before signaling.
  • Over take and allow to be overtaken safely with proper caution giving appropriate signals.
  • Give appropriate signals by hand or by electrical indicators clearly without mistake.
  • Change the lanes using proper signals with care.
  • Stop the vehicle in an emergency safely.
  • Use of the reverse gear while driving the vehicle backwards with reasonable accuracy.
  • Use the forward and reverse gears to change the face of vehicle in opposite direction.
  • Take correct and prompt action at signals given by traffic signs ,signals, policemen and other road users.
  • Drive cautiously at pedestrians crossings giving preference to persons crossing the road.
  • Keep well to the left in normal driving.
  • Regulate the speed to suit varying road and traffic conditions.
  • Demonstrate control of the vehicle by confident steering and smooth gear changing and braking as and when required.
  • Make proper use of rear view mirror before signaling, maneuvering, overtaking , turning to right or stopping.
  • Use proper side when driving straight, turning and at road junctions.
  • Make proper use of accelerator, clutch, gears, brakes, steering and horn.
  • Anticipate the actions of other road users.
  • Take precautions at intersections & road junctions to adjust the speed , proper positioning of the vehicle , use rear view mirror & avoidance of cutting right hand corner.
  • Concentrate on driving with attention & presence of mind.
  • Show courtesy & consideration for other road users keeping in mind the road safety.

  • A person is granted the driving licence after successfully passed the test of competence to drive. If he does not pass the said test then he may appear for re test after a period of seven days.

Renewal of driving licence

Information

  • A applicant may apply for renewal of his driving license 30 days before its expiry to the Licensing Authority. Apply Online for Renewal.

  • The driving licence is renewed with effect from the date of its expiry when the application is made before its expiry or within thirty days grace period. The driving licence is renewed with effect from the date of renewal when the application is made after the grace period.
  • The driving licence cannot be renewed after the period of five years when it has ceased to be effective.
  • If the licence is from other state it is desirable that the applicant should bring No Objection Certificate (N.O.C.) / confirmation of driving licence from Original Licensing Authority.

Duplicate licence

Validity of motor driving licence

Validity of Motor Driving Licence

  • Learner's Licence : 6 Months
  • Transport Licence : 3 Years
  • License to drive vehicle carrying hazardous chemicals : 1 Year
  • After the age of 50 yrs : 5 Years
  • All other class of licence (Till the age of 50 years) : 20 years or up to the age of 50 yrs whichever is earlier

International driving permit

  • Congratulations for getting Visa to visit foreign country for study purpose, employment or even for tourist purpose. If you are interested to show your skills on foreign land you are required to obtain International driving permit. IDP is valid only in the country we have signed under UN conversion.
  • International driving permit is delivered to the applicant in person.

  • Applicant should submit the application in whose jurisdiction he stays. It is advisable to applicant to get the necessary changes about the address on motor driving License before submitting the application for IDP.

Disqualification & Revocation

Disqualification & Revocation

  • Is a habitual criminal or a habitual drunkard; or
  • Is a habitual addict to any narcotic drug or psychotropic substance within the meaning of the Narcotic Drugs and Psychotropic Substances Act, 1985; or
  • Is using or has used a motor vehicle in the commission of a cognizable offence; or
  • Has by his previous conduct as driver of a motor vehicle shown that his driving is likely to be attended with danger to the public; or
  • Has obtained any driving licence or a licence to drive a particular class or description of motor vehicle by fraud or misrepresentation; or
  • Has committed any such act which is likely to cause nuisance or danger to the public, as may be prescribed by the Central Government, having regard to the objects of his Act; or
  • Has failed to submit to, or has not passed, the test referred to in the proviso to sub-section (3) of section 22; or
  • Being a person under the age of eighteen years who has been granted a learner's licence or a driving licence with the consent in writing of the person having the care of the holder of the licence and has ceased to be such care,

  • It may, for reasons to be recorded in writing, make an order -

  • Disqualifying that person for a specified period for holding or obtaining any driving licence to drive all or any classes or descriptions of vehicles specified in the licence; or
  • Revoke any such licence
  • Where an order under sub-section (1) is made, the holder of a driving licence shall forthwith surrender his driving licence to the licenceing authority making the order, if the driving licence has not already been surrendered, and the licensing authority shall, -
  • If the driving licence is a driving licence issued under this Act, keep it until the disqualification has expired or has been removed; or
  • If it is not a driving licence issued under this Act, endorse the disqualification upon it and send it to the licensing authority by which it was issued, or
  • In the case of revocation of any licence, endorse the revocation upon it and if it is not the authority which issued the same, intimate the fact of the revocation to the authority which issued that licence:
  • Provided that where the driving licence of a person authorizes him to drive more than once class or description of motor vehicles and the order, made under sub-section (1), disqualifies him from driving any specified class or description of motor vehicles, the licensing authority shall endorse the disqualification upon the driving licence and return the same to the holder.
  • Any person aggrieved by an order made by a licensing authority under the sub-section (1) may, within thirty days of the receipt of the order, appeal to the prescribed authority, and such appellate authority shall give notice to the licensing authority and hear either party if so required by that party and may pass such order as it thinks fit and an order passed by any such appellate authority shall be final.

Departmental action on driving lincence

Suspension of driving License in certain cases

  • Where, in relation to a person who had been priveously convicted of an offence punishable under section 184, a case is registred by a police officer on the allegation that such person has, by such dangerous driving as is referred to in the said section 184, of any class or description of motor vehicle caused the death of, or grievous hurt to, one or more persons, the driving License held by such person shall in relation to such class or description of motor vehicle becomes suspended -
    • For a period of six months from the date on which the case is registred, or
    • If such person is discharged or acquitted before the expiry of the period a foresaid, until such discharge or acquitted, as the case may be.
  • Where, by virtue of the provisions of the sub-section (1), the driving License held by a person becomes suspended, the police officer, by whom the case referred to a sub-section (1) is registered, shall bring such suspension to the notice of the Court competent to take cognizance of such offence, and the notice of the Court shall take possession of the driving License , endorse the suspension thereon and intimate the fact of such endorsement to the licensing authority by which the License was granted or last renewed.
  • Where the person refered to in sub-section (1) is acquitted or discharged, the Court shall cancel the endorsement on such driving lincence with regard to the suspension thereof.
  • If a driving License in relation to a particular class or description of motor vehicles is suspended under sub-section (1), the person holding such License shall be debarred from holding or obtaining any License to drive such particular class or description of motor vehicles so long as the suspension of the driving License remains in force.

Suspension or cancellation of driving License on conviction

  • Without prejudice to the provisions of the sub-section (3) of section 20 where a person, refered to in sub-section (1) of section 21 is convicted of an offence of causing, by such dangerous driving as is referred to in section 184 of any class or description of motor vehicle the death of, or grievous hurt to, one or more persons, the Court by which such person is convicted may cancel, or suspended for such period as it may think fit, the driving License held by such person insofar as it relates to that class or description of motor vehicle.
  • Without prejudice to the provisions of sub-section (2) of section 20, if a person, having been previously convicted of an offence punishable under section 185 is again convicted of an offence punishable under that section, the court, making such subsequent conviction, shall, by order, cancel the driving License held by such person.
  • If a driving License is cancelled or suspended under this section, the Court shall take the driving License in its custody, endorse the cancellation or, as the case may be, suspension, thereon and send the driving License so endorsed to the authority by which the License was issued or last renewed and such authority shall, on receipt of the License , keep the License in its safe custody, and in the case of suspended License , return the License to the holder thereof after the expiry of the period of suspension on an application made by him for such return: Provided that no such licence shall be returned unless the holder thereof has, after the expiry of the period of suspension, sundergone and passed, to the satisfaction of the licensing authority by which the License was issued or last renewed, a fresh test of competence to drive referred to in sub-section (3) of section 9 and produced a medical certificate in the same form and produced a medical certificate in the same form and in the same manner as is referred to in sub-section (3) of section 8.
  • If a licnece to drive a particular class or description of motor vehicle cancelled or suspended under this section, the person holding such a License shall be debarred from holding, or obtaining, any licnece to drive such particular class or description of motor vehicles so long as the cancellation or suspension of the driving License remains in force.

Power of Court to disqualify

  • Where a person is convicted of an offence under this Act or of an offence in the commission of which a motor vehicle was used, the Court by which such person is convicted may, subject to the provisions of this Act, in addition to imposing any other punishment authorized by la, declare the persons so convicted to be disqualified, for such period as the court may specify, from holding any driving License to drive all classes or description of vehicles, or any particulars class or description of such vehicles, as are specified in such License. Provided that in respect of an offence punishable under section 183 no such order shall be made for the first or second offence.
  • Where a person is convicted of an offence under clause (c) of sub-section (1) of section 132, section 134 or section 185, the Court convicting any person of any such offence shall order the disqualification under the sub-section 132 or section 134, such disqualification shall be for a period of not less than one month, and if the offence is related to section 185, such disqualification shall be for a period of not less than six months.
  • A Court shall, unless for special reasons to be recorded in writing it thinks fot to order otherwise, order the disqualification of a person -
    • Who having been convicted of an offence punishable under section 184 is again convicted of an offence punishable under that section,
    • Who is convicted of an offence punishable under section 189, or
    • Who is convicted of an offence punishable under section 192:
    • Provided that the period of disqualification shall not exceed, in the case referred to in clause (a), five years, or, in the case referred to in clause (b), two years or, in the case referred to in clause (c), one year.
  • A court ordering the disqualification of a person convicted of an offence punishable under section 184 may direct that such person shall, whether he has previously passed the test of competence to drive as referred to in sub-section (3) of section 9 or not, remain disqualified until he has subsequent to the making of the order of disqualification passed that test to the satisfaction of the licensing authority.
  • The Court ordering to which an appeal would ordinarily le from any conviction of an offence of the nature specified in sub-section (1) may set aside or vary any order of disqualification made under that sub-section not withstanding that no appeal would lie against the conviction as a result of which such order of disqualification was made.

Unfitness to drive a vehicle

Unfitness to drive a Vehicle

    The motor driving licence can not be issued to a person/applicant who is suffering from

  • Defects of vision which cannot be corrected by spectacles.
  • Colour or night blindness.
  • Hearing defects which cannot be corrected with the help of hearing aid.
  • Epilepsy.
  • Sudden attacks of loss of consciousness or giddiness.
  • Who has lost either hand or foot.
  • Suffer from any other disease or disability likely to cause danger to other road users. While driving is unfit to hold a driving licence.

Services on Existing License

  • Change of address should be intimated within 30 days.
  • APPLICATION FORM - Plain paper application mentioning old as well as present address.
  • DOCUMENTS TO BE SUBMITTED - Original driving license, address proof, No objection certificate wherever applicable along with. Fees.
  • WHERE TO MAKE APPLICATION - Application has to be made to the Licensing Authority which issued driving license. If present address of the applicant is in jurisdiction of other Licensing Authority, then NO Objection Certificate (NOC) has to be taken from the Licensing Authority which issued the Driving License and submit this NOC to the Licensing Authority where applicant is presently residing along with original Driving License and address proof.

Endorsement by Courts

A Court convicting a holder of a license, for any one of the offences specified hereunder shall endorse or cause to be endorsed in the driving license, the particulars of such conviction, namely

  • Driving without license, or without a license which is effective, or without a license applicable to the vehicle driven (Section 3).
  • Allowing a license to be used by another person [Section 6(2)].
  • Driving when disqualified (Section 23).
  • Driving an unregistered vehicle (Section 39).
  • Driving a transport vehicle not covered by a certificate of fitness (Section 56).
  • Driving a transport vehicle in contravention of Section 66.
  • Driving in contravention of Rule 118.
  • Failure to comply with provision of Section 114.
  • Refusing or failing within specified time to produce license or certificate of registration (Section 130).
  • Failing to stop vehicle as required under Section 132.
  • Obtaining or applying for a license without giving particulars of endorsement (Section 182).
  • Driving at excessive speed (Section 183).
  • Driving dangerously (Section 184).
  • Driving while under the influence of drink or drugs (Section 185).
  • Driving when mentally or physically unfit to drive (Section 186).
  • Abetment of an offence punishable under Section 183 or 186.
  • Abetment of offence specified in Section 188.
  • Taking part in unauthorized race or trial of speed (Section 189).
  • Using vehicle in unsafe condition (Section 190).
  • Driving vehicle exceeding permissible limit or weight (Section 194).
  • Altering a license or using an altered license.
  • An offence punishable with imprisonment in the commission of which a motor vehicle was used.

Temporary Registration

Important

  • No dealer of vehicle can deliver the unregistered motor vehicle to the purchaser. He can only deliver the vehicles which are temporarily /permanently registered with R.T.O.
  • No owner of a motor vehicle can allow or permit the use of unregistered vehicle.
  • No person can drive a motor vehicle, which is not registered with R.T.O.

Who will need Temporary Registration

  • Transport Vehicle that need time to construct the body of vehicle over the chassis
  • Non-transport vehicles are required to be taken to place of registration from the dealer's premises

Procedure

  • An application for temporary registration shall be made in form C.R Tem.A.
  • Register your vehicle at the registering authority (RTO) in whose jurisdiction you reside or you have a place of business where the vehicle is normally kept.

Validity

  • Temporary Registration is valid for the period of 7 days initially and extended up to not exceeding 30 days incase of non transport vehicles. This validity is extended for some more period with the permission of Registering Authority in case of transport vehicles.

Registration of New Vehicle

Important

  • No dealer of vehicle can deliver the unregistered motor vehicle to the purchaser. He can only deliver the vehicles which are temporarily /permanently registered with R.T.O.
  • No owner of a motor vehicle can allow or permit the use of unregistered vehicle.
  • No person can drive a motor vehicle, which is not registered with R.T.O.
  • Get the vehicle registered directly from the dealer on his trade certificate.
  • Produce vehicle for inspection to RTO . Vehicle is inspected by an inspector of Motor Vehicle to confirm the provisions of Act & Rule, then vehicle tax is recovered & new registration number is assigned.

How to Apply

Register the new vehicle within 7 days from the date of taking delivery from the dealer excluding the period of journey for vehicles on temporary registration.

  • Roadworthiness certificate in form 22 ,22-A from the manufacturer.
  • Purchase invoice (for vehicles attracting life time tax).

  • Address proof.
  • Roadworthiness certificate in form 22-A part II from the body builder for transport vehicles.
  • Bill of entry for imported vehicles.
  • Octroi receipt if registering in municipal limits.
  • Manufacturers certificate for invalid carriage.
  • Customs clearance certificate in case of imported vehicles along with License & bond if any.
  • Design approval from Transport Commissioner in the case of a trailer.
  • 7/12 abstract or tahasildar certificate in the case of agricultural tractor & trailer for Tax Exemption.
  • Entry tax payment proof if any vehicle, body or tanker is purchased from outside the state.

Registration of outstate vehicle or Assignment of new registration mark RMA

Important

  • If vehicle registered in one state is to be kept or used in other state for the period of more than a year then the vehicle needs to be registered in the latter state new registration number to be assigned. While doing so, the NOC from original registering authority & consent of financier (in case of loan) needed to be furnished.

Registration for VIP Numbers

Conditions

  • Under MMVR 1989 R54 the applications for new VIP Numbers will be accepted from 5th February 2002 onwards during office hours.
  • On grant of the VIP Numbers the applicant shall pay the prescribed fees on the same day or on the following day during cash hours from 10:00 A.M. to 2:30 P.M.
  • If a particular registration number is sought by more than one applicant, the registration mark shall be allotted by way of auction.
  • Reservation for such numbers will be in force and will be valid for 30 days only.
  • All applications on plain paper will be accepted at R.T.O. main office by the concerned clerk of Non-Transport Series.

No-Objection Certificate

No objection certificate (N.O.C)

  • Apply Online for N.O.C.
  • Form–28 (3 copies with signature of registered owner and chassis print affixed on each copy).
  • Form-29 (in case of sale of vehicle).
  • NOC from financier if any.
  • NOC from police dept (if NOC is to be taken outside Maharashtra State) stating that no case relating to the theft of motor vehicle concerned has been reported or is pending.
  • All valid documents - PUC certificate, Insurance certificate, Registration Certificate, Tax Certificate.

Cancellation of N.O.C.

  • Surrender the original copy of NOC obtained earlier to the original registering authority (RTO).
  • Certificate of the registering authority on whom the NOC was earlier issued stating that the said vehicle has not been registered at that office.
  • An affidavit from the owner of the vehicle stating that he has not mis-used the vehicle and the NOC from the period of obtaining the NOC.
  • Fee Rs. 100 for all types vehicles.
  • All valid documents.

Transfer of Motor Vehicle Ownership

Insurance

Motor Vehicle Insurance

The motor vehicle insurance certificate is a legal requirement as per Chapter XI of Motor Vehicle Act 1988 (sec 146 & 147). It gives financial protection from accidental risk. It is very much dangerous and illegal to drive a motor vehicle without insurance.

  • Driving or allowing a vehicle to be drive on road without proper insurance cover is serious offence under the Motor vehicles Act 1998, so also is an act of irresponsibility, which everyone should avoid.
  • Under the Provision of Section 140, any road accident victim, can avail of compensation under the principle of no fault. Further, under section 163 of Motor Vehicle Act 1998, the compensation to the road accident victim is given in Hit and Run cases.

Type of motor vehicle insurance

  • Third party policy :This covers the risk or damages caused to the third person. Personal injuries and personal vehicle damages will not be covered by this policy. For two wheeler vehicles we can take this policy for life time. For other vehicles this policy has to be renewed annually. This is the cheapest available motor vehicle insurance policy. This policy can be renewed two months in advance of its expiry.
  • Comprehensive policy :This is the costly policy. It covers both personal and third party risk. We have to renew this policy annually, and it can be renewed two months in advance anywhere in India.

Duplicate insurance certificate

  • If the motor vehicle insurance certificate is lost or defaced, duplicate copy may be obtained by making an application to the concerned Insurance company branch by paying fees.

Transfer of insurance

  • Third party insurance policy changes automatically when the registered owner changes. In case of comprehensive policy an application is to be made for change of ownership in the policy.

Accident Claims

To obtain motor vehicle claims of an accident, one has to make detailed claim to the concerned insurance company. One who makes a claim application has to give following documents:

  • Valid Driving License.
  • Valid insurance certificate.
  • Valid registration certificate.
  • Valid tax certificate.
  • First information report (FIR).
  • Valid permit for a transport vehicle.
  • Valid fitness certificate for transport vehicles.
  • Claim estimation report by an authorised surveyor of the company.
